Terms of Service

Welcome to Quandify AB (“Quandify”, “we”, “our”, or “us”).

These Terms of Service (“Terms”) govern your use of Quandify’s connected devices, software, and cloud services, including:

  • all Quandify-branded hardware devices,
  • the Quandify App (iOS / Android), and
  • the Quandify Platform services (collectively, the “Services”).

By creating an account, installing, or using any Quandify device or Service, you agree to these Terms.

2. Eligibility and scope

These Terms apply to:

Consumers 
Who purchase or use Quandify devices for personal or household purposes, and

Business Customers
E.g., property owners, facility managers, insurers, resellers, or partners) who deploy Quandify devices or integrate Quandify Platform data within their own systems.

For Business Customers, any signed master, reseller, or data-processing agreement takes precedence over these Terms in case of conflict.

3. Account creation and security

  • A Quandify account is required to use most Services.
  • You are responsible for safeguarding your login credentials.
  • Quandify may suspend or delete accounts used in violation of these Terms or applicable law.

Business Customers are responsible for ensuring that their authorised users comply with these Terms.

4. Device and service use

4.1 Intended use

Quandify devices are connected sensors and monitoring solutions designed for measuring, analysing, or detecting conditions within water or environmental systems.

4.2 Installation and operation

Follow the official Quandify installation and safety instructions available in product manuals or on the Quandify Resource Center (https://support.quandify.com/). Incorrect installation can affect performance or void warranty.

4.3 Software and firmware updates

Quandify may automatically provide software or firmware updates that enhance security, functionality, or compliance. Use of the Services implies consent to receive such updates.

4.4 Data generation and access

Quandify devices generate usage and environmental data that are transmitted securely to the Quandify Platform. Users can view and manage data in the Quandify App and may request exports or deletion as set out in the Privacy Policy.

5. Data protection and privacy

Quandify acts as data controller for consumer accounts and as data processor for business deployments where the customer controls end-user data. All processing complies with the General Data Protection Regulation (GDPR) and the EU Data Act. Details on data categories, purposes, storage, and retention are provided in the Privacy Policy.

Users can exercise rights of access, correction, portability, and erasure by contacting privacy@quandify.com.

6. User obligations

Users agree to:

  • Use Quandify devices and Services only for lawful, intended purposes
  • Maintain accurate account and contact information
  • Not attempt to reverse-engineer, decompile, or modify Quandify hardware or software
  • For Business Customers, ensure their own customers or occupants receive proper information about data collection and privacy rights.

7. Licences and intellectual property

  • All intellectual-property rights in Quandify hardware, firmware, software, and the Platform remain with Quandify AB.
  • Quandify grants users a limited, non-exclusive, non-transferable licence to use the Services for legitimate monitoring and analysis purposes.
  • The Quandify name and logo are trademarks of Quandify AB.

8. Subscriptions and payment terms

Certain Services or integrations may require a paid subscription.

  • Pricing and billing intervals appear at purchase or in partner agreements.
  • Fees are non-refundable except where required by consumer-protection law.
  • Business Customers must pay invoices within the stated term; overdue amounts may incur interest under the Swedish Interest Act (1975:635).

9. Service availability and quality

Quandify aims for > 99 % uptime ****of its platform.

  • Maintenance windows are announced in advance whenever feasible.
  • Device data typically uploads hourly, with event-based reporting for alerts.
  • Short interruptions may occur due to connectivity or maintenance.

Quandify is not responsible for outages caused by user networks, internet providers, or power failures.

10. Warranty

10.1 Consumers

Quandify devices carry a legal warranty that conforms with EU and Swedish consumer law. Quandify will repair or replace defective products during this period.

10.2 Business Customers

Business customers are subject to separate agreements.

11. Limitation of liability

To the maximum extent permitted by law:

  • Quandify is not liable for indirect, incidental, or consequential damages (including lost profits or data) arising from use of the Services.
  • Quandify’s total liability shall not exceed the amount paid for the affected product or one year’s subscription, whichever is higher.
  • Nothing limits liability for death or personal injury caused by negligence, fraud, or wilful misconduct.

Consumers retain all mandatory statutory rights.

12. Third-party services

Quandify Services may interoperate with third-party platforms (e.g., smart-home systems, utility dashboards). Use of such platforms is subject to the third party’s own terms and policies. Quandify is not responsible for their performance or compliance.

13. Termination

Users may terminate their account at any time via the Quandify App or by emailing privacy@quandify.com. Quandify may suspend or terminate access for misuse, non-payment, or legal requirements. Upon termination, personal data is deleted or anonymised according to the Privacy Policy.

14. Governing law and dispute resolution

These Terms are governed by Swedish law (excluding conflict-of-law rules).

Consumers
Disputes may be submitted to the Swedish National Board for Consumer Disputes (ARN).

Business Customers
Disputes shall be finally settled according to separate agreements.

15. Changes to these Terms

Quandify may update these Terms to reflect service or legal changes. Users will receive at least 30 days’ notice before material updates take effect. Continued use after that date constitutes acceptance.

Appendix A – Key Definitions

Account
The user profile enabling access to Quandify Platform and App.

Business Customer
A legal entity purchasing Quandify devices or Services for professional use.

Consumer
A natural person using Quandify products outside trade or profession.

Device Data
Operational, usage, or diagnostic data generated by a Quandify device.

Services
All Quandify hardware, software, cloud, and support offerings.
